2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 109, 3(5) of the Indian Penal Code . 3 . It is alleged that these two petitioners along with one unknown accused assaulted father of informant with sticks and hammer due to which he sustained severe injuries and during treatment after 42 days of alleged occurrence he died.
4. It is submitted on behalf of the petitioners that both parties are neighbours and due to trivial dispute a simple occurrence of maarpeet took place between them. Case and
Patna High Court CR. MISC. No.27014 of 2025(2) dt.06-05-2025 2/2 counter case . The present F.I.R., has been lodged after the delay of 5 days.
5 . Learned counsel for the State and informant opposed the bail petition and submitted that petitioners are named in the F.I.R., and there is specific allegation against them that they assaulted father of informant as a result or which he died. Petitioner No. 1 has got 5 criminal antecedents and petitioner No. 2 has got 4 criminal antecedents. 6 Considering the nature of accusation , criminal antecedents of these petitioners and circumstances of the case , prayer for pre -arrest bail of these petitioners is rejected.
