The petitioner apprehends his arrest in connection with Complaint Case No.1340(C) of 2013 registered under Sections 420, 467, 468, 471, 406 and 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the complaint petition that Ashish Kumar approached the Mahindra and Mahindra Finance Services Ltd. Biharsharif (Sohsarai) Branch, for loan to purchase the truck and, accordingly, agreement deed was prepared for sanctioning the loan of Rs.17,85,000/- in which Ashish Kumar and Arun Tiwary put their
Patna High Court Cr.Misc. No.60562 of 2017 (2) dt.13-12-2017 2/2 signatures. The petitioner had no role in sanctioning of the loan in favour of Ashish Kumar rather it has only been alleged that the petitioner was present at the time of execution of the agreement in between the complainant/opposite party no.2 and borrower Ashish Kumar.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Biharsharif at Nalanda, in connection with Complaint Case No.1340(C) of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
