2. This is the second anticipatory bail application filed by the petitioners, apprehending their arrest in connection with Anti P.S. Case No. 69 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 85, 80, 238 and 3(5) of the BNS, 2023.
3. The prosecution story, in brief, is that informant's sister marriage was solemnized with Vikas Kumar on 16.07.2024. Soon after her marriage she had been continuously harassed and tortured by her in-laws. Whenever he used to visit
2/4 his sister in-her laws house, his sister complained that all her inlaws including her husband made pressure on her for dowry of Rs. Two lakhs and for vehicle and gold chain. It is further alleged that when she refused to accede to their demand, they all used to assault her. When he tried to intervene and want to meet his sister at Village Tineri they all scolded him and expelled him from there. On 01.06.2025 at about 2:30 AM, he got information that his sister had died in her matrimonial house and found that no one was present. Subsequently, he found cremation of her dead body, but no member from matrimonial house was seen. Thereafter, he was informed by wife of one Chandan Kumar, that his sister had died and her body was already cremated. After her death, one of her in-laws informed him about her death. It is further alleged that all the persons of her matrimonial house were involved in disposal of her dead body after killing her for dowry.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence as alleged in the FIR. It is also submitted that the petitioners were not involved in the crime and the allegations levelled against the petitioners are false and baseless. It is also submitted that the petitioners have no criminal antecedent and on this ground,
3/4 prayer for grant of anticipatory bail has been made for the second time.
5. Earlier these petitioners were not granted anticipatory bail vide order dated 17.02.2026 passed in Cr. Misc. No. 7647 of 2026. Considering the facts and circumstances of the case and the gravity of allegation of the offence, no change circumstance has been brought forward for maintaining the second anticipatory application. From the perusal of the case record and as per the FIR, all the petitioners named in the FIR are responsible for causing dowry death of the deceased (the sister of the informant) and there is further allegation of performing last rites of deceased by in-laws without informing the unnatural death of the deceased. In the impugned order passed by the Court below, it has also been observed that the prosecution witnesses have supported that the deceased died in mysterious and unnatural circumstances and hurriedly cremation of deceased reflects an act of disappearing or hiding evidence of the offence. For these reasons, this Court is not inclined to entertain the second anticipatory bail application and hence, it is rejected.
6. It is clarified that in the previous order dated 17.02.2026 passed in Cr. Misc. No. 7647 of 2026, while
4/4 rejecting the anticipatory bail application, paragraph 4 in the said application was inadvertently typed which has no corelation with the facts of the present case. (Alok Kumar Sinha, J) kiran/- U T
