This application for anticipatory bail arises out of Dehri Nagar P.S. Case No. 473 of 2018 for the offence punishable under Sections 403, 409 and 420 of the Indian Penal Code.

The petitioner, at the relevant point of time, was Block Supply Officer, who has since retired. The matter relates back to the year 2010, when he was posted as Block Supply Officer, Dehri. The allegation against the petitioner is of drawal of more wheat than that was allotted for distribution among A.P.L. families, which was not distributed.

Learned counsel appearing on behalf of the petitioner has submitted that since the matter relates to the year 2010, the petitioner should be allowed anticipatory bail. It has secondly been submitted that petitioner being a retired

Patna High Court CR. MISC. No.30946 of 2019(2) dt.09-05-2019 2/2 Government servant, there is no chance of his absconsion from the investigation or trial.

Considering the above submission, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas, in Dehri Nagar P.S. Case No. 473 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
