The petitioner seeks regular bail in connection with Udakishunganj P.S. Case No. 31 of 2023 for the offence registered under Section 392 of the I.P.C.

As per prosecution case, allegation against the petitioner and the other accused persons is that they have surrounded the informant and snatched his mobile on gun point while he was going on bicycle along with cousin Krishna Kumar.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to inimical term with regard to transaction of money. He has further submitted that there is no recovery of any

Patna High Court CR. MISC. No.30448 of 2023(2) dt.13-06-2023 2/2 incriminating article from conscious possession of the petitioner. Petitioner has no criminal antecedent and he is in jail custody since 17.02.2023.

Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Udakishunganj, Madhepura in Udakishunganj P.S. Case No. 31 of 2023, subject to the following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
