2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 323, 307, 341, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, on 19-01-2024 at 11.00 A.M, due to land dispute, all the FIR named accused persons including this petitioner and 5-6 unknown persons ccame to the house of informant and started indiscriminate firing, due to which elder brother and mother of informant got seriously injured.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of firing is against other co-
Patna High Court CR. MISC. No.31735 of 2024(3) dt.11-07-2024 2/2 accused persons. So far as this petitioner is concerned, there is no allegation of assault against him. He was only a member of mob. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Danapur, Patna in connection with Piplawan P.S. Case No. 12/2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
