====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code and later on, Section 411 of the Indian Penal Code was added.

3. As per prosecution case, on 17-07-2019, the tractor of the informant, bearing registration no. BR26GA-3477, was stolen from the door at around 1:30 in the night and F.I.R. was lodged against unknown, however; during course of investigation, one Abhishek Kumar was apprehended and in his confessional statement, he disclosed the name of petitioner and other, as his associates.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The petitioner's name

Patna High Court CR. MISC. No.30677 of 2025(2) dt.04-07-2025 2/2 surfaced during the course of investigation and the stolen tractor was recovered near the house of Karu Yadav. No incriminating articles has been recovered from conscious possession of this petitioner. The petitioner is in custody since 28.02.2025.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Muffasil P.S. Case No. 166 of 2019.
