2. Petitioner seeks bail who is in custody since 01.03.2026 in connection with Mehus P.S. Case No. 19 of 2023 for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 302, 504, 506 of I.P.C.
3. The case of the prosecution in brief as per First Information report inter alia is that on 9.6.2023 at about 9.00 A.M. Ravi Sav started verbally abusing the informant's family without any provocation. At that time the informant and his family did not read. Later on at evening about 5.00 P.M. the informant's father Karu Sao went to know reason with accused family members. No.30086 of 2026(3) dt.08-07-2026 2/3 spades (Kutta) Accused Ravi Sao struck the victim with Khanti causing his eye to pop out following this accused Naveen Sao delivered a for awful blow to the victim's head with spade and an iron rod due to which he had sustained head injury. By the time informant and other arrived at the place of incident the accused persons had fled away. Thereafter informant's family initially took the victim cum injured to Sadar Hospital where from he was referred to Pawapuri. Upon reaching Pawapuri the doctor further referred him to Patna while in route to Patna the victim succumbed to his injuries and passed away. After his death the body was brought back to Sadar Hospital Sheikhpura. The Mehus Police station was informed about the incident via Phone. The police subsequently arrived at Sadar Hospital and facilitated postmortem examination of the deceased.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and is innocent and he has falsely been implicated in the present case. It is further submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR. It is next submitted that it appears from the FIR that due to some pity dispute the present occurrence has taken place and there is no specific allegation of assault or overt
Patna High Court CR. MISC. No.30086 of 2026(3) dt.08-07-2026 3/3 act against the petitioner rather the allegations are general and omnibus in nature.

The learned Additional Public Prosecutor for the State on the basis of materials available on record and the case diary has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the FIR it appears that there is direct and specific allegation against the petitioner that he has assaulted to the informant's father with spade over his head and during the course of treatment the father of the informant has passed away. Apart from aforesaid, medical evidence (postmortem report) also supports the allegation as alleged in the FIR.

Considering the nature of allegation and the fact that there is direct and specific allegation of assault against the petitioner supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Mehus P.S. Case No. 19 of 2023 pending in the court of learned District & Additional Sessions Judge-II, Sheikhpura.
