The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The petitioner is the husband of the informant. This is a case under Section 498A of the Indian Penal Code. The petitioner is ready for restitution of conjugal right with the informant.
Informant has appeared through Vakalatnama but no one is appearing.
In the circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below
Patna High Court Cr.Misc. No.54539 of 2016 (3) dt.02-03-2017 2/2 within a period of thirty days from the date of receipt of the order, be released on provisional anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Civil Lines Police Station Case No. 42 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The provisional bail would be confirmed by the learned court below, if the petitioner is found co-operative in reconciliation talk between the parties otherwise the court below would be at liberty to cancel the provisional anticipatory bail of the petitioner.
