The petitioners are apprehending their arrest in connection with Rajauli P.S.Case No. 138 of 2016 registered for the offences punishable under Sections 341, 323, 504, 506, 308 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that there is case and counter case between the parties and there is enmity from before between them and except omnibus allegation of assault there is nothing against the petitioners and it appears from the case diary that one of the injuries was kept reserved for its opinion and other injuries are simple in nature. Heard learned APP also.

Having heard both sides and in view of the facts stated

Patna High Court Cr.Misc. No.48695 of 2016 (3) dt.08-02-2017 2/2 above, let the petitioners, named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S.Case No. 138 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the further conditions that the petitioners will co-operate in investigation of the case and make themselves available before the police as and when required and in case of failure on their part to appear before the police, their bail bonds shall be liable to the cancelled.
