2. In the present case, the petitioner seeks bail in connection with NTPC P.S. Case No. 12 of 2026 registered for the alleged offence under Section 309(4) of BNS.

3. As per prosecution case, unknown thieves, threatening the informant with knife, took away a wooden box containing some articles belonging to NTPC. The name of the petitioner transpired during investigation for dealing with the stolen articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR and he is a scrap dealer and he has been arrested merely on suspicion. Nothing

The petitioner is having antecedent of one case which also arises from the same occurrence and he has been granted bail in the said case by the learned court below itself. The petitioner is in custody since 26.02.2026.

5. Learned APP for the State opposes the submission made on behalf of the petitioner. The learned APP submits that the stolen article has been recovered from this petitioner, who has been named by the other co-accused persons who used to purchase the stolen articles from the co-accused persons.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna/court concerned in connection with NTPC P.S. Case No. 12 of 2026, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.

7. However, it is made clear that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
