Petitioner seeks bail in a case registered for the offences punishable under Sections 392,394 of the Indian Penal Code.

Petitioner is in custody since 19.09.2019.

In the past, petitioner had approached this Court against refusal of the prayer for bail vide Cr. Misc. No.13580 of 2020 and that application was disposed off by order dated 29.02.2020 as the learned court below had permitted the petitioner to renew the prayer for bail after framing of the charge.

This Court directed the learned court below to frame the charge within a period of one month from the date of receipt/production of a copy of that order.

Patna High Court CR. MISC. No.29020 of 2020(3) dt.24-02-2021 2/2 Learned counsel for the petitioner submits that charges have not been framed and the report of the learned Trial Judge dated 03.12.2020 also reveals that charges have not been framed.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jehanabad Rail Police Station Case No.44 of 2018 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
