====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-06-2018 Heard Sri Awadhesh Kumar, learned counsel for the petitioner and Sri Ajay Kumar Jha, learned Additional Public Prosecutor.

The sole petitioner, having clean antecedent , which fact has been stated in paragraph no. 3 of the petition, apprehending his arrest in connection with Bhakhtiyarpur ( Barh) Rail P.S. Case No. 33 of 2017, Special Case No. 676 of 2017 , registered for offence under Section 30(A) of the Bihar Prohibition & Excise Act, 2016 and Section 34 of the Indian Penal Code, 1860, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner submits that petitioner has been made accused on the basis of confessional

Patna High Court Cr.Misc. No.36401 of 2018(2) dt.28-06-2018 2/2 statement of the co-accused , otherwise, neither anything was recovered from possession of the petitioner nor any other cogent material is there to connect the petitioner in the present case.

Considering the nature of accusation , clean antecedent of the petitioner as well as the fact that petitioner has been made accused on the basis confessional statement, in the event of his arrest or surrender within a period of six weeks from today, let petitioner Pramod Kumar @ Pramod Thakur @ Parma be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge ( Excise ) cum Addl. District Judge, Patna / concerned court in connection with Bhakhtiyarpur ( Barh) Rail P.S. Case No. 33 of 2017 , Special Case No. 676 of 2017 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure, 1973.
