The petitioner apprehends his arrest in connection with Mansahi P.S. Case No. 61 of 2016 registered under Sections302/201 of the Indian Penal Code. It is submitted that the petitioner is innocent. The dead body of the deceased was not recovered and no case u/S 201 of the Indian Penal Code is made out. The petitioner has been made accused on the basis of mere suspicion.
In the statement made by the witnesses, vide paragraphs-17, 19 & 36 of the case diary, petitioner's involvement emanated in this case.
Taking into consideration the above-said facts and
Patna High Court Cr.Misc. No.54418 of 2016 (3) dt.14-02-2017 2/2 circumstances of the case as well as submission of the parties, I do not think it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Mansahi P.S. Case No. 61 of 2016 stands rejected.
