JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 18-08-2018 The present writ petition has been filed for a direction to the respondents to stop functioning of the Primary Agriculture Cooperative Society, (PACS), Semraon Panchayat of Charpokhari Block in the District of Bhojpur as a PDS licence which is granted in the light of Public Distribution System (Control) Amendment Order, 2011 issued by the State Government vide memo no. 5738 dated 23.06.2011.
2. At the very outset, learned counsel for the petitioner submits that it will suffice if the petitioner is granted liberty to file a fresh representation before the Sub Divisional Officer-cum-Licencing
Patna High Court CWJC No.16208 of 2015 dt.18-08-2018 Authority, Piro, Bhojpur (Respondent No. 3) for redressal of his grievances, in which event, the present writ petition need not be pressed on merits.
3. Learned counsel for the respondents appears and has been heard.
4. Having regard to the nature of the grievances and the stand of the petitioner, the present writ petition is disposed of with liberty to file a fresh representation before Sub Divisional Officer-cum-Licencing Authority, Piro, Bhojpur (Respondent No. 3) for redressal of his grievances. If any such representation is filed within a period of two weeks from today, the same shall be considered and disposed of expeditiously and preferably within a further period of eight weeks thereafter in accordance with law.
