The petitioners are apprehending their arrest in connection with Supaul P.S. Case No. 79 of 2018, registered for offences punishable under Sections 420, 467, 468 and 34 of the Indian Penal Code.

Allegation against the petitioners is that they have got sale deed executed from his nephew on the pretext that he will pay the consideration money but he has not paid the consideration money and get the sale deed executed.

Submission of the learned counsel for the petitioners is that

Patna High Court Cr.Misc. No.35031 of 2018 (2) dt.06-07-2018 2/2 petitioner No.1 is the uncle of informant and petitioner No.6 is the witness and others are the family member. It is also submitted that even according to the registered sale deed, there is averment before Registrar that the informant has paid all the consideration money for the sale deed and now, as the rate has been enhanced and he is making false allegation against the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No.79 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
