The petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

Learned senior counsel for the petitioner submits that petitioner is in custody since 10.03.2021 and has antecedent of six cases, it is next submitted that informant alleges that on 13.08.2020 at about 10.00 PM, her husband went out of the house along with his friends namely Ganaur Sahani and others, she further alleges that her husband did not return, though she had a talk with him at about 10:00 PM, it is further alleged that on 14.08.2022 at 08:00 AM she came to know that her husband

Patna High Court CR. MISC. No.30021 of 2022(4) dt.09-02-2023 2/2 was shot dead by some unknown persons at Bedauli Chowk. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that FIR is against unknown and the petitioner came to be implicated based on his criminal antecedent, it is further submitted that petitioner was arrested in Singhwara P.S. Case No. 195 of 2020 and on the date of arrest in the said case he was made to confess that he sought the deceased of the present case, it is thus submitted that based on his confessional statement in police custody in a different case, the petitioner came to be implicated in the present case, it is also submitted that no doubt petitioner has antecedent of six cases but he is on bail in all the cases.

At this stage, the learned senior counsel seeks permission to withdraw the regular bail application. Permission is accorded with liberty to renew his prayer for bail after framing of charge.
