JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-12-2015 Heard both sides The nature of the grievance raised through this writ application, in my view, should not be gone into in writ jurisdiction of this Court.

The grievance is that the petitioner was selected for giving the benefit under the Indira Awas Yojana inasmuch as bank accounts was also got opened. Subsequently, the respondent denied the benefit. An enquiry was held by the Additional Collector, Buxar ( copy of the enquiry report has been annexed as Annexure-B to the counter affidavit) wherein it was found that the husband of the applicant(writ petitioner) had been granted the said benefit and as such the petitioner although selected does not

Patna High Court CWJC No.16420 of 2012 (2) dt.07-12-2015 2/2 qualify for the said benefit. The petitioner was found as the wife of Chirkut Ram. The contention of the petitioner is that she is wife of Ramayan Ram and not Chirkut Ram who was given the said benefit under the Indira Awas Yojana. The ends of justice shall be sub served if the petitioner is granted a liberty to raise such grievance before the District Magistrate who will be in a better position to appreciate the grievance of the petitioner. If any such application is filed, I am sure, the District Magistrate shall give due consideration to the said application and pass appropriate orders in accordance with law as quickly as possible preferably within two months from the date of filing of such application.
