2. Petitioner seeks regular bail in connection with Punpun P. S. Case No. 279 of 2025 registered for the offences punishable under Sections 140(1), 103(1), 238 and 61(2) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, on 11.09.2025, informant got to know that all the F.I.R. named accused persons, including this petitioner and some unknown persons, took away Subodh Kumar, Dhiraj Kumar, Lovely Kumari and Sudhanshu Kumar. On 12.09.2025, dead bodies of informant's son, namely Subodh Kumar and Lovely Kumari were found near the railway track.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.31107 of 2026(2) dt.14-05-2026 2/2 petitioner is quite innocent and has committed no offence. Informant is not an eye witness to the occurrence and petitioner has falsely been implicated in this case merely on the basis of information given by one Pramod Kumar. During investigation, Dhiraj Kumar, who was also alleged to have been kidnapped by the accused persons, was recovered and in his statement, he has not named this petitioner as one of the kidnappers. Petitioner is father of the deceased Lovely Kumari. Petitioner claims clean antecedent and is in custody since 10.10.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, materials available on record, clean antecedent, and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Masaurhi, Patna in connection with Punpun P. S. Case No. 279 of 2025.
