JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 18-08-2018 The present writ petition has been filed for quashing the order dated 26.07.2013 passed in Appeal No. 17/2004-05 by the District Magistrate, Gaya by which the aforesaid appeal against the order dated 13.07.2004 passed by learned Sub-Divisional Officer, Sherghatty cancelling the PDS licence No. 36/85 has been dismissed for default.
2. None appears on behalf of the petitioner despite repeated calls. Learned counsel for the respondent appears.
3. At the very outset this Court takes note that the petitioner has approached this Court after considerable delay of more than two years the appeal was dismissed for default. The petitioner appears to have neither approached the District Magistrate for recall of the order nor preferred revision against the appellate order.
