The petitioner seeks pre-arrest bail in connection with Mirganj P.S.Case No. 162 of 2005 registered under Section 393 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Considering the fact that the FIR was instituted 13 years ago naming the petitioner as one of the accused as also gravity of the offence and the fact that he is accused in one another case, I am not inclined to grant him pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being
