JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 420, 406, 379, 120(b)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons under criminal conspiracy misappropriated Rs. 20 lakhs which was to be deposited in different ATMs.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner was simply cashier in Secure Value India Ltd. Branch, Machhipur and on the alleged date of occurrence he along with other accused persons proceeded to deliver cash in ATM and when it was detected that Rs. 20 lakh is missing

Patna High Court CR. MISC. No.39607 of 2021(3) dt.17-11-2021 2/2 proper intimation was given to Branch Manager, Secure Value India Ltd. No money has been recovered from the possession of the petitioner and only on suspicion petitioner has been made accused in this case. Petitioner claims clean antecedent and is in custody since 20.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria PS case No. 241/2021.
