JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 23-08-2018 Complaining air and noise pollution on account of some diesel generator set operating in the petitioner's locality, he has approached this writ Court for appropriate directions to prevent such air and noise pollution.
2. Counter affidavit has been filed on behalf of the respondent no. 2. Specific stand is that after detailed enquiry into the petitioner's complaint, the member Secretary of the State Board under letter no. T-4058 dated 07.07.2017 has sent a communication to the District Magistrate, Patna regarding the existence of diesel generator set being complained by the petitioner, and the fact that emission of noise from the generator set was beyond the prescribed limit.
3. None appears on behalf of the petitioner. However,
Patna High Court CWJC No.9408 of 2015 dt.23-08-2018 2/2 since the matter is an issue of pollution, this Court would dispose off the writ petition with expectation that the respondent no. 3, District Magistrate, Patna will take appropriate consequential action in light of the letter dated 07.07.2017.
