Petitioners apprehend their arrest in a case registered for the offence punishable under Section 30 of the Bihar Prohibition and Excise Act.

250 liters of foreign liquor has been recovered from behind the house and Gumti of these petitioners. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners rather the aforesaid recovery is from a public place. Petitioners

Considering the facts of the case, in the event of arrest/surrender, let both the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act Saran at Chapra in Morhowrah Police Station Case No. 680/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
