JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioner is apprehending his arrest in connection with Mahua P.S. Case No. 212 of 2017, registered for offences punishable under Sections 302, 201, 380 and 34 of the Indian Penal Code.

Petitioner happens to be co-villager and there is allegation against him and other accused persons of causing death of the deceased.

It has been submitted on behalf of the petitioner that there is no specific allegation has been attributed against him and he is co-villager and the other accused persons having similar allegation has been granted privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 27.02.2018 passed in Cr. Misc. No.6492 of 2018 and vide order dated 01.05.2018 passed in Cr. Misc. No.17399 of 2018.

No.37247 of 2018 (3) dt.20-07-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Vaishali at Hajipur in connection with Mahua P.S. Case No. 212 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) It is further made clear that the petition in no way shall threaten the informant otherwise the informant may move for cancellation of his bail bonds.
