====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 13.03.2018 in a case for the offence registered under Sections 448, 323,324 and 307 of the IPC.

The prosecution story, in brief, is that on 13.03.2018 at about 5.00 A.M. when the informant was at his house only, one Ramdev Bharti (petitioner), suddenly entered his house and locked the room where his 11 months' old grand-daughter, Sonalika Kumari was sleeping inside the room, assaulted her and attacked with Iron rod. When the informant alongwith other villagers got the room unlocked, they found that the victim girl Sonalika Kumari was badly injured and was bleeding. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Nature of injury is simple. No offence under Section 307 of the IPC is made out. The petitioner has already been remained in custody for more than one year. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Sherghati, Gaya (Bihar), in connection with Imamganj P.S. Case No. 24 of 2018.
