The present writ petition has been filed for commanding the respondent no. 3 to accept the financial bid of the petitioner which was rejected only on the ground that some correction has been made by the petitioner after filing the financial bid giving the estimated rate below 025% below the estimated rate of the notice inviting tender; and for connected reliefs.

3. Learned counsel for the petitioner fairly states that the relevant agreement contemplated a period of two months for completion of the work in terms of Office Order No. 2 dated 07.01.2012 (Annexure-1), which has already elapsed.

4. In that view of the matter, the prayer in the writ petition has been rendered infructuous by efflux of time and no positive relief can be granted at this belated stage.

5. The application is accordingly dismissed as having become infructuous.
