2. The petitioner is apprehending his arrest in connection with Khagaria (Muffasil) P.S. Case No. 348/2022, dated 22.04.2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was also added which is pending in the Court of learned C.J.M., Khagaria.
3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.
4. Permission is granted.
5. Accordingly, the instant application is dismissed
Patna High Court CR. MISC. No.35003 of 2023(2) dt.25-07-2023 2/2 as withdrawn.
6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order considering this fact that petitioner was working in the C.R.P.F..
