JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 341, 323, 447, 504, 324, 307, 506, 379 and 325 of the Indian Penal Code. Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that there is case and counter case between the parties. There is allegation of assault by bhala and talwar. From the injury reports (Annexures-2 and 2/1) it appears that all the injuries are reserved and nothing has been stated as to what type of injuries are found on the injured person. It has further been submitted that the accused persons have already been granted anticipatory bail by this Hon'ble Court vide order dated 14.12.2016 passed in Cr. Misc. no. 46985 of 2016.

Having heard both sides, in view of the fact that there is case and counter case between the parties and injury reports do not show any specific injury against the petitioners, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Nawada, in connection with Sirdala (Meshkaur) P.S. Case no. 127 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local having property within the jurisdiction of the court concerned and petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
