JUSTICE RAKESH KUMAR ORAL ORDER 04-07-2018 Heard Sri Alok Kumar Singh, learned counsel for the petitioner and Sri Bharat Lal, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Alamnagar P.S. Case No. 45 of 2018 registered for offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016, has prayed for grant of anticipatory bail. Learned counsel for the petitioner, at the very outset , by way of referring to the statement made in paragraph 3 of the petition, submits that the petitioner is having clean antecedent. He further submits that due to village politics, the petitioner has falsely been made accused on an allegation of recovery of 4 litres of Mahua liquor from an open hut showing, as if, the said place was belonging to the petitioner.

Be that as it may, considering the nature of accusation

Patna High Court Cr.Misc. No.37946 of 2018(2) dt.04-07-2018 2/2 as well as fact that the petitioner is having clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Sudip Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Uda-Kishunganj, Madhepura in connection with Alamnagar P.S. Case No. 45 of 2018, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
