JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 30-01-2023 Learned counsel for the appellant submits that in terms of the Hon'ble Division Bench Judgment of this Court in the case of Kusheshwar Purbey and Ors. vs. Shri Shri 108 Ram Janaki Jee S. and Ors. reported in 2017(3) PLJR 791, an appeal filed after 27.02.2012 under Section 299 of the Indian Succession Act, 1925 is to be treated for all purpose as first appeals. Learned counsel submits that in view of the said judgment, this case is required to be registered as a regular first appeal. He seeks permission to convert this appeal in a first appeal.

Permission is granted. Let this case be converted in a regular first appeal within a period of four weeks from today. The Registry shall examine the pending appeals registered as miscellaneous appeals under Section 299 of the Indian Succession Act and shall take corrective measures in accordance
