The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 364A/34 of the Indian Penal Code.

As per the prosecution case, while the informant was returning from his office on 28.08.2014 at 8.30 P.M. after performing his duty on motorcycle, he was intercepted by the accused persons, caught the informant and forcibly seated in a four-wheeler. It is further alleged that all the accused persons shut the eyes of the informant and, as such, the informant suspected that he had been kidnapped. Thereafter, the informant was brought in a house of miscreants where he was provided food and later on released on 30.08.2014 by them after realizing that due to misconception that the informant has been kidnapped.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner. It is

No.33313 of 2019(2) dt.31-07-2019 2/2 further submitted that FIR has been lodged against unknown and the name of this petitioner has surfaced on the basis of a mobile no.8521164837 which is in the name of this petitioner. The name of this petitioner has been transpired on this basis of confessional statement of co-accused Pappu Rai, save and except, there is nothing against this petitioner. Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sheohar/successor Court in connection with Piprahi P.S.Case No.97 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
