The petitioner has prayed for bail in a case instituted for the offence under Sections 341, 342, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

As per allegation in the FIR, two sons of the petitioner have threatened the son of the informant because of providing information about illegal excavation of sand to the police. It is further alleged that petitioner abducted the informant's son and killed him by assaulted him repeatedly with iron rod on his head. When the informant came there to save his son, accused Deepak Kumar Singh assaulted him by means of iron rod on his head.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case.

Patna High Court CR. MISC. No.33013 of 2023(4) dt.23-08-2023 2/2 General and omnibus allegations have levelled against the petitioners. As per medical report, injuries received by injured Ajay Kunwar and Kunal Kunwar, are simple in nature caused by hard and blunt substance. Petitioners have got no criminal antecedent and both are languishing in judicial custody since 24.2.2023.

The application for bail is opposed by learned APP for the State and learned counsel for the informant and submitted that both injured were received injuries on head which is vital organ. Injured Kunal Kuwar was admitted in AIIMS Patna for about one month because of his serious condition. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st, Sheohar in connection with Piprahi PS Cae No. 36 of 2023.
