The petitioner seeks anticipatory bail in connection with Forbesganj P.S. Case No. 233 of 2002, registered for offences punishable under Sections 489 (B) (C) and 420 of the Indian Penal Code.
Allegation as per FIR is that the petitioner has given ten notes of five hundred rupees to the informant for the purchase of the buffalo from the informant in which nine of them are found fake.
Submission of the learned counsel for the petitioner is that except confessional statement of one Md. Mumtaz, the name of the petitioner surfaced and nothing has been recovered from the possession of the petitioner and the petitioner has no criminal

Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders before the court below within a period of six weeks from the date of the order, he will be released on provisional bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 233 of 2002, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
