JUSTICE SANJAY PRIYA ORAL ORDER 02-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Laheriasarai P.S. Case No. 319 of 2016 instituted for the offence under sections 406 and 420 of the Indian Penal Code.

It is submitted on behalf of the petitioner that on account of dispute with regard to payment of salary, the informant has filed this case against him. He was not paid salary for the period of five months. There is no recovery of any incriminating articles.

In the written report, it was alleged that he was working in the office of the informant for the last nine months and he took away mobile and sim of the company which was given to him. He did not return the same and later on, the mobile phone

Patna High Court Cr.Misc. No.3160 of 2017 (3) dt.02-03-2017 was found switched off when the informant tried to contact the petitioner.

C.D. has been received.

The learned A.P.P. has submitted that almost all the witnesses have stated similarly. But there is no recovery of any incriminating articles from the possession of this petitioner. In this manner, mere suspicion has been raised against this petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Laheriasarai P.S. Case No. 319 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under section 438(2) Cr.P.C.
