The petitioner apprehends his arrest in Nardiganj P.S. Case No. 177/2018, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Prosecution case is that seven litres of country made liquour was recovered by the side of a river and two persons were also apprehended by the police.

It is submitted on behalf of the petitioner that name of this petitioner has come in this case on the basis of disclosure made by the apprehended accused. There is no material against this petitioner. Similarly situated co-accused has been granted anticipatory bail by a Coordinate Bench of this court vide order dated 28.01.2019 passed in Cr. Misc. No. 4340/2019.

No.27048 of 2019(3) dt.17-07-2019 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IInd-cum-Special Judge, Nawada in connection with Nardiganj P.S. Case No. 177/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
