====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2021 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 323, 377, 504, 506 of the Indian Penal Code and Sections 4, 6, 8, 10 & 12 of the Prevention of Children from Sexual Offences Act, 2012.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application with a direction to the trial court to conclude the trial preferably within a period of nine months from the date of receipt/production of copy of the order. The allegation against the petitioner is that the petitioner committed unnatural sexual assault with the victims.

Patna High Court CR. MISC. No.29207 of 2020(3) dt.03-02-2021 2/2 A report was called for from the trial court. It appears from the report that witnesses are the residents of different states and there is no likelihood of the trial being concluded in near future. The petitioner is in custody since 30-08-2018. He has remained in custody for nearly two and half years.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) to the satisfaction of learned Additional District & Sessions Judge-Istcum-Special Judge, POCSO Act, Gaya in connection with Bodh Gaya P.S. Case No. 515 of 2018.
