JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Roh P.S. Case No. 48 of 2016, registered for the offences punishable under Sections 406, 409, 420 and 201 of the Indian Penal Code.

Allegedly, the petitioner being panchayat Secretary of Gram Panchayat, Madra, did not submit folders and relevant documents regarding appointment of teachers.

Submission is of false implication and that the petitioner has retired on 31.05.2016 itself and, as such, after his retirement F.I.R. has been lodged, the petitioner was never informed to submit folder or documents, he has already given

No.12279 of 2017 (3) dt.24-03-2017 2/2 charge of all the relevant documents and papers, no offence as alleged is made out against the petitioner as no document remains with the petitioner after his retirement and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. V, Nawada, in connection with Roh P.S. Case No. 48 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
