JUSTICE SANJAY PRIYA ORAL ORDER 18-10-2017 Heard learned counsel for the Petitioner and the State. The instant application has been filed for modification of the order dated 06.09.2017 passed by this Court in Cr. Misc. 40690 of 2017.

The Petitioner was allowed anticipatory bail by the order dated 06.09.2017 passed by this Court in Cr. Misc. 40690 of 2017.

It has been submitted that due to inadvertence in the original bail petition, "Chief Judicial Magistrate, Madhubani" has wrongly been mentioned whereas it should have been "Sub Divisional Judicial Magistrate, Benipatti". Accordingly, in the aforesaid order, the same mistake has occurred. In such circumstances, let 8th line of last paragraph of the order dated 06.09.2017 passed in Cr. Misc. No. 40690 of 2017 in place of "Chief Judicial Magistrate, Madhubani" be read as

Patna High Court Cr.Misc. No.50621 of 2017 (2) dt.18-10-2017 2/2 "Sub Divisional Judicial Magistrate, Benipatti". The order dated 06.09.2017 passed in Cr. Misc. No. 40690 of 2017 is modified to the extent indicated above. In such circumstances, further four weeks' time is granted to the Petitioners from the date of receipt/production of copy of this order to surrender before learned Sub Divisional Judicial Magistrate, Benipatti, in connection with Khirhar P.S. Case No. 54 of 2013, G.R. No. 2681 of 2013 in terms of the order dated 06.09.2017 passed by this Court in Cr. Misc.40690 of 2017. This modification application stands allowed.
