JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Akabarpur P.S. Case No. 40 of 2016 registered under Sections341, 504, 506, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioners are alleged to have attempted to murder the informant. In the scuffle the informant received bullet injury.

Learned counsel for the petitioners submits that the injury in question is simple in nature. Petitioners have no criminal antecedent.

Learned Addl. P.P. appearing for the State opposes

Patna High Court Cr.Misc. No.38049 of 2016 (3) dt.02-02-2017 2/2 the prayer for anticipatory bail and submits that there is a direct allegation against the petitioners and they are named accused. During examination, witnesses have supported the prosecution case. In supervision note, the case has been found to be true against these petitioners.

Considering the nature of allegations levelled against the petitioners and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of anticipatory bail to these petitioners. Their prayer for anticipatory bail is, therefore, rejected.
