Petitioner seeks regular bail in a case registered for the offence punishable under Section 401 of the Indian Penal Code and and u/s 25(1-B)A, 26, 35 of Arms Act. . As per the prosecution case, on the disclosure made by the two accused persons, who were apprehended on the spot, that they had hidden arms beneath a bush, whereafter five country made pistols and 10 live cartridges were recovered. Petitioner is said to be accomplice.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the
Patna High Court CR. MISC. No.38570 of 2021(2) dt.17-01-2022 2/2 confessional statement of co-accused, who were apprehended on confessional statement of co-accused, who were apprehended on the spot. No incriminating article has been recovered from the possession of the petitioner. Petitioner is in custody since 05.01.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha PS case No.227/2020.
