2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:

"That this an application is being filed for quashing of th order dated 21.05.2013 arising out of Madhubani Town P.S. Case No. 69 of 2011 dated 04.03.2011 whereby and where under learned Court below has taken cognizance against the petitioner under sections 443, 448, 427, 353 of the I.P.C."

3. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the application with liberty to move a proper application before the Court below at the appropriate stage.

4. In view thereof, the application stands disposed off as withdrawn with liberty aforesaid.

5. If the petitioner files any application at the appropriate stage before the Court below, the same shall be considered on its own merit, in accordance with law, without being prejudiced by the present order.
