JUSTICE RAKESH KUMAR ORAL ORDER 28-06-2018 Heard Sri Yogendra Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph no. 3 of the petition, apprehending his arrest in connection with Excise Case No. 95 of 2018 ( PR. 06/18-19 ) Muzaffarpur, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner has drawn my attention to the report at page no. '9' to show that nothing was recovered from premises of the petitioner or his conscious possession, rather in the case from the house of co-accused
Patna High Court Cr.Misc. No.36257 of 2018(2) dt.28-06-2018 2/2 Suddu Paswan total about 47.220 liters of foreign liquor was recovered and petitioner without any rhyme and reason has been arrayed as accused as if he was the supplier. In the report also nothing has been indicated except suspicion. Besides hearing, I have perused the materials available on record and after going through the same, I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly , in the event of his arrest or surrender within a period of six weeks from today, let petitioner Pramod Chaudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Muzaffarpur / concerned court in connection with Excise Case No. 95 of 2018 (PR-06/18-19) Muzaffarpur subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure, 1973.
