2. The petitioner has preferred this application for grant of regular bail in connection with Jagdishpur P.S. Case No. 21 of 2025 dated 03.02.2025 registered for the offences punishable u/ss 130(1), 127(1), 115(2), 118(1), 74, 352, 351(2), 351(3) read with section 3(5) of the BNS.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have abused the informant's husband and the petitioner and co-accused caught hold of the informant's husband and the co-accused Subodh Choudhari assaulted him with Dabiya on his head causing severe injury to him. It is further alleged that Raja Chowdhari also assaulted the
Patna High Court CR. MISC. No.27496 of 2025(3) dt.13-05-2025 2/2 informant and her son with lathi causing injury.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of assaulting the informant's husband is against the co-accused Subodh Chaudhari. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.02.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Jagdishpur P.S. Case No. 21 of 2025.
7. The application stands allowed.
