2. The petitioners seek bail in connection with Bheldi P.S. Case No. 356 of 2024 instituted for the offences punishable under Sections 310 (2) of the B.N.N.S., 2023 (395 I.P.C.).
3. As per the prosecution case, all the accused persons committing loot-paat took away gold chain, Mobile sets, ATM card, Aadhar card and cash of Rs. 5,700/- from the informant on the gun point.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and have falsely been implicated in this case without any cogent material. He submits that petitioners are not named in the FIR
3/4 and his name surfaced in this case only on the basis of self confessional statement. He further submits that there are no any incriminating articles recovered from the conscious possession of the petitioners and the petitioners have not put on Test Identification Parade till date. Petitioners are in custody since 21.12.2024.
5. Learned APP opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned District and Additional Sessions Judge-14th, Saran at Chapra dated 07.04.2025, it appears that petitioners are not named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant namely Pappu Kumar Singh, FIR has been registered under Sections 310 (2) of the B.N.N.S., 2023 (395 I.P.C.) against two unknown persons. During investigation the petitioners have been arrested in this case from Garkha P.S. Case No. 680 of 2024 and on the basis of self confessional statement of the petitioner (Hridya Nut @ Hirdyanat). It is also submitted by learned counsel for the petitioners that investigation has completed and chargesheet has been submitted in this case but no Test Identification Parade has been conducted till date and no recovery has been made from the conscious possession of the petitioners, so considering all
4/4 these aspects of the matter, I am inclined to grant bail to the petitioners.
7. Accordingly the prayer for bail of the petitioners are allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Class, Saran at Chapra / Concerned Court in connection with Bheldi P.S. Case No. 356 of 2024.
