====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-12-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Amarpur P.S. Case No. 214 of 2020 registered for the offences punishable under Sections 120(B), 302/34 of the Indian Penal Code. The case of the prosecution in short is that on 02.05.2020 at about 07:30 p.m., the petitioner Sujesh Kumar along with some other accused persons called the husband of the informant who was a barber. That the husband of the informant did not return to his house and next morning at 05:00 a.m., the informant heard that her husband Dinesh Thakur was killed, then she went at the place of occurrence and saw the dead body of her husband, she also saw multiple injuries on his head, she has firm believe that the petitioner also was involved in killing her husband as he always forced the deceased to cut their hairs

Patna High Court CR. MISC. No.28679 of 2020(3) dt.15-12-2020 2/2 and shave their beard during lockdown, which he used to refuse. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further stated that the allegatioin against the petitioner is vague and omnibus and there is no criminal antecedent against the petitioner. He further submits that other co-accused has been granted bail by different Bench of this Court.

Learned A.P.P. for the State opposed the bail petition and submits that the witnesses have supported the case of the prosecution. As per the postmortem report, multiple lacerated wound on scalp was found.

In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail. Accordingly, the prayer for bail of the above named petitioner in connection with Amarpur P.S. Case No.214 of 2020 pending in the court of learned Chief Judicial Magistrate, Banka is hereby rejected at this stage.
