The petitioners apprehend their arrest in a case registered for the offence under Section 406, 409 of the Indian Penal Code.
As per the prosecution case, Rs. 9,50,000/- was paid through cheque to the petitioners, who are Chairman and Secretary of the Managing Committee respectively, under the Nal Jal Yojna, but the work has not been completed even after withdrawal of the said money.
It is submitted on behalf of petitioners that work in question has already been completed. In this regard, Technical Assistant (J.E.), Block Kochas, vide letter dated 31.03.2022, has confirmed that till 04.03.2022, as per measurement book, work worth Rs. 10,25,326/- has already been completed. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Bikramganj (Rohtas) in connection with Dinara P.S. Case No. 146 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
