====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-05-2019 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Jagdishpur (Goradih) P.S. Case No. 376 of 2018, instituted for the offence under Section (s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioners submits that petitioners are not named in the written report. The informant who is wife of the
Patna High Court CR. MISC. No.29141 of 2019(2) dt.07-05-2019 2/2 deceased has earlier filed written report against unknown. It is alleged that after about two months of the occurrence, the informant has filed petition before the learned Chief Judicial Magistrate on 29.9.2018, naming four accused persons including petitioner. In that petition also the informant has merely raised suspicion against the petitioner. Thereafter, the petitioner has been made accused on the basis of aforesaid petition. Petitioner is in custody since 17.11.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur (Goradih) P.S.
