Although the issue as to the termination on account of non passing of the efficiency test in second attempt has been interfered by the Apex Court and thereafter State-respondent have issued clarificatory order for providing further opportunity, the present writ petition has become academic. Mr. Ram Kihsore Singh, learned counsel for the petitioner submits that in fact the finding of the respondent that the petitioner failed in the second attempt is erroneous and contrary to record.
He submits that in view of the error of record,
Patna High Court CWJC No.6257 of 2015(2) dt.27-11-2018 2/2 direction may be issued to the respondent so that mistake may be rectified. If this is the factual position, liberty is granted to the petitioner to file representation before the District Programme Officer (Establishment) who shall verify the record and if it is found that there is error of record, the District Programme Officer shall rectify the mistake and adopt corrective measure and issue corrected order within a period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
