====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-11-2018 The petitioner is aggrieved by the inaction on the part of the respondents in the matter of grant of promotion under ACP Rules to the petitioner.
Learned counsel for the petitioner submits that the petitioner had superannuated in 2012 and as such he was entitled to grant of ACP. He further submits that similarly circumstanced other teachers have been granted the benefit of ACP on completion of 12 years and 24 years but the case of the petitioner has been treated differently.
Considering the fact that the petitioner has superannuated and till date there is no decision on the claim of the petitioners, the respondents are directed to take final decision on the claim of the petitioner for grant of ACP under
Patna High Court CWJC No.6531 of 2015(2) dt.27-11-2018 2/2 the ACP Rules if similarly circumstanced teachers have been granted ACP, within a maximum period of four months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
